在SBS〈美好的早晨〉放送之前，一直都看不見在中出現在電視上吧？

不過還是有意外的啦，發現的時候眼淚都要掉出來了，即使只有一秒鐘、兩秒鐘也好。

[NEWS] Courts Dismiss All SM Injunctions & “Legally Guarantee JYJ’s Independent Activities”


The Seoul District Courts has dismissed all formal objections against JYJ’s injunction as well as the exclusive contract suspension injunction filed by SM Entertainment against JYJ’s Kim Jaejoong, Kim Junsu and Park Yoochun.

On the 17th, the Courts made it known that they have dismissed all claims filed by SM Entertainment, which is the agency’s formal objection against JYJ’s injunction as well as its exclusive contract suspension injunction.

This means that the Courts have emphasized their decision that the contract signed between the members of JYJ and SM is invalid and that the members’ independent activities are guaranteed. They have also publicized that SM Entertainment cannot interfere with JYJ’s activities in the entertainment activities on the claim that their contract with the agency is still valid.

The Courts laid down the verdict that SM Entertainment’s formal objection is invalid on the premise that:
▲the exclusive contract in question can be categorized as a submissive contract as it does not give the celebrity the freedom of choice and instead forces him to follow the orders of the entertainment agency,
▲the members of JYJ could do nothing but follow SM’s orders as they were placed in an inadequate position compared to SM in terms of bargaining power,
▲the exclusive contract’s extreme long-term subordinate nature cannot be justified by pretexts including the decrease of investment risks and ensuring a stable entrance into foreign markets,
▲other than the long-term nature of this exclusive contract, clauses including that which gives SM Entertainment direct superintendency over JYJ’s every move as well as that which calls for excessive compensation for a breach of contract strengthen the submissive nature of this contract and place the members of JYJ in an unilaterally disadvantageous position.

Regarding the injunction filed by SM to suspend the exclusive contract signed between the members of JYJ and C-JeS Entertainment, the Courts dismissed the injunction on the grounds that,
▲as long as the verdict made on October, 2009, which includes the decision that SM must not interfere with JYJ’s independent activities in the entertainment industry, is valid, SM’s request to suspend the validity of the business commission contract signed between the members of JYJ and C-JeS Entertainment is not allowed as it goes completely against the previously stated verdict,
▲and stressed that SM cannot exert the direct superintendency, given to them by their exclusive contract, over JYJ’s activities in the entertainment industry as of now.

不過，The legal battle between SM and JYJ is not yet over. This court decision is merely regarding a preliminary injunction, this does not mean that the exclusive contract between SM and JYJ is invalid. The original lawsuit is still ongoing, and the date of pleading will be in March.

JYJ’s Kim Jaejoong Says, “I Learned Of Taking Things Slow And The Power Of Time”~ ^O^
It is sometimes cruel to be placed at crossroads and told to choose. For we will gain things but also lose things. It is not an easy task to state and differentiate between the pros and cons of choices because there is no standard to compare your choi⋯⋯ce with and because the tables may turn in an instant.

JYJ’s Kim Jaejoong, who recently stood at one of the most important crossroads in his life, didn’t say much at first and gave a relaxed smile for a while. He finally opened his mouth to speak when we asked him, ‘Are you content with your life right now?’. His answer was short and precise. “I’ve finally realized just how good it feels to be free.” But it took him over a year to find his balance once more; now, he remains unshaken even when his surroundings suddenly shift. It is because he has learned to accept reality and feel joy in the smallest things.

“I don’t feel uncomfortable talking about my past. That’s why I’m able to write ‘JYJ from 東方神起’ in my Twitter profile and it’s also why my phone’s start-up screen is a picture of TVXQ.”

Kim Jaejoong was confident about one thing, that “We will all be together one day.” Regarding the uncertain future, he believes that, “Time will heal all.” A year ago, he was so confused about his life that he had to take it one day at a time. He couldn’t make himself believe that he would be able to enjoy every day of his life or that he would be able to try anything he wanted to. He was able to feel a great sense of accomplishment from being the director of JYJ’s World Tour, which began in Thailand on the 2nd and 3rd of this month. He has now begun to dream a new dream.

“I want to try acting in a drama or a musical.” Kim Jaejoong’s new dream is to act and that is one thing that his fans are dying to hear news about. The project that C-JeS Entertainment has been preparing for a long time is Kim Jaejoong’s debut into the Korean drama industry. His name has been mentioned many times during the casting of dramas such as <Goddess of War:Athena> and <HanBanDo>.

“Our management company suggested several big projects to me. They would place the documents in front of me and say ‘Kim Jaejoong, we’ve prepared this just for you.’ Some were really good and some were too much for me to handle. My eagerness is growing as I approach my dream, step by step. I believe there will come a day when all the things I’ve been preparing will come to life.”

Kim jaejoong’s dream has already almost come true. He appeared in the drama <Sunao Ni Narenakute> with Japanese actors such as Ueno Juri and Eita. The rest will come true once he debuts in a Korean drama.

“I was planning on appearing in a Korean drama pretty soon, but I felt like I needed more time. But I’m not going to rush into it. I’m waiting for the right time to make my entrance.”

He is trying to not rush into things these days. Though all the dramas that were suggested to him were large-scale productions, he just wants to act in a drama that fits him well, regardless of its scale. He knows so well that appearing in a large-scale drama or taking on an extravagant role isn’t what it takes to repay his fans for waiting so long without disappointing them. He believes that even if he receives a small role, he must become immersed in his character and give an amazing performance. He said, “I’m undecided because I’ve received so many offers.”

Exactly one week after the interview was held, Kim Jaejoong uploaded a photo onto his personal Twitter account. It was a picture of his fellow members Kim Junsu and Park Yoochun joking around and grabbing each other by the collar, as if they were fighting. He uploaded the photo with a couple of captions, “How happy I am!” and “They get along so well that it’s becoming a problem!” The words he had said during his interview popped into my head as I saw his tweets.

“I wonder if there was ever a time when I laughed as much and as comfortably as I do now. Everytime I see Junsu and Yoochun and think that it’s only the three of us, my heart jolts. I often feel happy that we are together and that we are making things happen with what we’ve got. I’m glad that fans are beginning to realize this though they were worried at first. Though we know what their worries are, I just want them to watch over us. We’ve held on so far. I always have and always will believe in the power of time.“
